A Davis-Stirling Compliant

California Civil Code so your board can stop worrying and start serving owners.
The Two Things Keeping Boards Up At Night
California's Davis-Stirling Act and the new AB 2159 electronic voting law have made an old-school binder-and-mailer HOA effectively non-viable. Here is what boards tell us actually scares them.
1. Davis-Stirling Disclosure Compliance
Civil Code §5300, §5310, §5550, §5200 and §4041 require boards to deliver annual budgets, policy statements, reserve studies, election rules and individual notices on strict timelines. Miss one and you risk lawsuits, voided elections, and personal board liability. A compliant website automates the delivery, dating and recordkeeping the statute demands.
2. AB 2159 Electronic Voting (Effective 2025)
California now permits HOAs to run elections by electronic ballot — but only if the association adopts updated election rules, gives 90+ days notice, preserves anonymity, and uses a verifiable platform. Paper-only elections are slow, expensive, and increasingly fail to make quorum. Boards that don't move to e-voting fall behind on basic governance.
Note: California does not impose a single blanket "every HOA must have a website" mandate, but the combined weight of Davis-Stirling disclosures, §4041 individual delivery elections, AB 2159 e-voting, §4365 IDR, §5910 ADR, §5660 pre-lien notice clocks, and §4525 escrow packets makes a compliant website the only practical way to operate. Small associations (under ~15 units) and certain non-residential CIDs have limited exemptions — we'll tell you up front if you qualify.
